13.2 Dispute Resolution

Any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the jurisdiction in which pkrbat operates. The arbitration shall be conducted in English.

13.3 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and Responsible Gambling guidelines, constitute the entire agreement between you and pkrbat regarding the use of the Site and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.

14.2 Severability

Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

14.5 Force Majeure

pkrbat shall not be liable for any failure or delay in performance under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
